Residency Challenge in Magistrate's Race?

It was previously noted here that Bernie O'Hare's Lehigh Valley Rambling's site (read it here) had a post related to an apparent violation of Election Law in the District Magistrate race by Mark Franczak.

Over the weekend another challenge was made on O'Hare's site, this time related to Franczak's residency (read it here). It appears that Franczak has a home in Bushkill Township and has lived there since 1986, but Bushkill is not included in this election district, so he has allegedly (based on a tip received by O'Hare) rented a room at the YMCA.

Election Law requires a Magistrate candidate to live in the district for one year prior to running for office.

O'Hare checked assessment records and the phone book and both showed Franczak located at the Bushkill address.

Franczak does not appear on the Borough of Nazareth (Wards I, II, & III) Street Lists of registered voters distributed by the Election Office. I did not have the Bushkill lists where the residence was located to see if he did show there (I believe it would be Bushkill Township - Bushkill Center Road).

Considering the position in question is the District Magistrate who will be making decisions of a legal nature, it would seem the integrity and ethics of candidates running for this seat should be beyond doubt. Since nothing is confirmed and most is observation, I'll hold judgment until Franczak either responds or is accepted as a candidate for office, but I do believe this is a situation we should all watch closely.
