The Business Meeting of the Nazareth Borough Council opened with Council President Dan Chiavaroli reading a letter of resignation from Councilman J. Michael Davis.
According to the letter, the resignation was effective as of the end of the September Business Meeting. He'd served 11 years on Borough Council, on school board and was priviledged to participate.
Davis held positions on ten committees, commissions, or as a representative of the Council on various boards and organizations.
Davis' resignation requires the Council to make an appointment. The By-Laws require Council to advertise one time for applications. All applications are to be made to the secretary-treasurer. The application will include a resume and statement of reasons for serving on Council.
Council will announce a time and place where all Council may read the applications. An interview will be held and a meeting order will be given.
The process follows regulations used since October 2004 and elected voters of the 3rd Ward are eligible to apply.
Council has 30 days from September 6 to fill the position. If it is not filled it goes to the Vacancy Board (whose only member is Evelyn Huth). The Vacancy Board has 15 days to make an appointment. If the Vacancy Board can not fill the position, then it goes to court.
A special meeting will be held before the next workshop at 6 p.m.
A recommendation was made by Council President Chiavaroli that with one person short, Council should take no action on this or any other building until the appointed person is on the Council.
A motion was approved to accept the resignation.
